Privacy Policy
Last updated 30 October 2026
This policy explains how SHERRY'S MERCHANTS ("we", "us") handles your personal data when you shop with us at sherrysmerchants.com. It is written to meet the information duty in section 29 of the Data Protection Act, 2019 (Kenya) and the data protection policy requirement in regulation 23 of the Data Protection (General) Regulations, 2021. It covers the nature of the data we hold, how to access it and exercise your rights, our complaints handling, our purposes and lawful bases, our obligations when data leaves Kenya, our retention schedule, and how we handle children's data.
1. Who we are and how to reach us
SHERRY'S MERCHANTS is the data controller for the personal data described in this policy: we decide why and how your data is processed. You are the data subject.

| Privacy contact | privacy@sherrysmerchants.com |
| Phone and WhatsApp | 0740 209 121 (+254 740 209 121) |
| Website | sherrysmerchants.com |

We do not charge for privacy requests. You do not need an account to make one, and you never have to buy anything to exercise your rights.
2. What we collect and where it comes from
We collect only what we need to run the store and meet the law.
| Category | What it includes | Where it comes from |
|---|---|---|
| Account data | Name, email address, hashed password, account identifier, role | You, when you create an account or sign in |
| Order and delivery data | Full name, email, phone number, county, street/address, the items ordered, quantities, prices and order status | You, at checkout |
| Payment data | Payment method chosen (M-PESA or pay on delivery) and the M-PESA transaction code you enter | You, at checkout. We never see your M-PESA PIN, card number or bank details — you enter a transaction code, not a password. |
| Marketing consent record | Your email address, whether you opted in or out, the date and time, and the source (for example "checkout") | You, when you tick or leave the marketing box at checkout |
| Cart and wishlist | Items you saved or added to your cart | Your activity on the site |
| Website usage data | Pages viewed, clicks, scroll depth, referring page, device and browser type, approximate location, session recordings (Microsoft Clarity), and ad interaction data (Meta Pixel, including the _fbp cookie) | Your browser, when you use the site |
| Support messages | What you ask us about orders, delivery or products | You, when you contact us |
| Notifications | Your device's push notification subscription, if you switch order notifications on | Your browser, if you allow notifications |
We do not intentionally collect sensitive personal data (such as health, biometric, religious or financial account details). If we ever receive sensitive data by mistake, we delete it unless the law requires us to keep it.
3. Why we collect it and the lawful basis
Under section 30 of the Data Protection Act, every use of your data must rest on a lawful basis, and further processing must match the purpose we told you about. We rely on the bases below and can demonstrate them on request (regulation 5).
| Purpose | Data used | Lawful basis |
|---|---|---|
| Taking and fulfilling your order, taking payment, arranging delivery | Order, delivery and payment data | Performance of a contract, or steps at your request before a contract — s.30(1)(b)(i) |
| Creating and operating your account, keeping your cart and order history | Account, cart, order data | Performance of a contract — s.30(1)(b)(i) |
| Sending order confirmations and delivery updates | Name, email, phone | Performance of a contract — s.30(1)(b)(i) |
| Keeping accounting, tax and consumer-law records | Order, payment and transaction records | Compliance with a legal obligation — s.30(1)(b)(ii) |
| Fraud prevention, misuse detection, site security | Usage, account and order data | Legitimate interests — s.30(1)(b)(vii), balanced against your rights |
| Marketing emails and SMS about offers and new stock | Name, email, phone, purchase interests | Your express consent — s.30(1)(a) and s.37(1)(a) |
| Retargeting ads and building ad audiences from purchases | Email (hashed), site activity, Pixel events | Your express consent — s.37(1)(a) and regulations 14–15 |
| Understanding how the site is used (heatmaps, recordings, analytics) | Usage data, Clarity cookies | Consent where required; otherwise our legitimate interest in improving the store — s.30(1)(b)(vii) |
| Answering your questions | Support messages, contact details | Legitimate interests — s.30(1)(b)(vii) |
Where we rely on consent, you can withdraw it at any time without affecting the lawfulness of processing that happened before (s.32). Consent must be freely given: we never make marketing or analytics consent a condition of buying from us, and the marketing box at checkout starts unticked.
4. Marketing choices
We only market to people who gave express consent (s.37 of the Act), for example by ticking the marketing box at checkout. You can also switch marketing on or off from your account or by messaging us.
- Every marketing email or SMS we send carries a clear, free and simple way to opt out — a prominent unsubscribe link or a one-word reply — as required by regulations 16 and 17.
- Opting out takes minimal time and effort and is free of charge. We honour it without asking you to give a reason, and we stop using your data for marketing once you do (regulation 16(2)).
- A request to stop marketing from third parties is handled within 7 days (regulation 18).
- We never disguise who a message is from, and we never use automated calling systems without a human involved.
- We do not sell, rent or trade your personal data to anyone. Purchase audiences we build for advertising are uploaded to the ad platform as hashed identifiers for matching only, under Meta's Custom Audience Terms.
7. Transfers outside Kenya
Some of the providers listed above store or process data outside Kenya, including in the United States. Sections 48 and 49 of the Act and regulations 40–42 of the General Regulations allow this only where appropriate safeguards are in place, the transfer is necessary for a contract with you, or you have consented.
- We rely on written contracts with each provider that impose protection substantially equivalent to the Act, together with a documented transfer assessment we keep and can produce to the Data Commissioner on request (regulation 41).
- We also rely on the necessity of these transfers for performing our contract with you (for example, hosting your order confirmation email).
- We do not claim that any such country has been assessed as adequate by the Data Commissioner unless it has.
- You may ask us for details of the safeguards we rely on by emailing privacy@sherrysmerchants.com.
8. How long we keep your data
We keep personal data only as long as it is reasonably necessary for the purpose it was collected for, or as long as the law requires (section 39 of the Act). When the period ends, we delete, anonymise or pseudonymise it. This schedule is our retention schedule under regulation 19.
| Data | Retention period | Why |
|---|---|---|
| Order, payment and delivery records | At least 5 years, and up to 7 years after the order where tax, accounting or consumer law requires it | Legal obligation; contract and warranty claims |
| Account profile (name, email) | While your account is open, then deleted or anonymised within 30 days of closure | Contract; no longer needed once the account is closed |
| Marketing consent and opt-out records | For as long as you are subscribed, and the timestamped record afterwards so we can prove consent | We must be able to demonstrate consent — s.32 |
| Support and complaint messages | Until the matter is resolved, then up to 24 months | Service quality; legal claims |
| Analytics and session recordings | Only for as long as needed for analysis and no longer than our provider's retention setting allows; we delete or restrict audiences that are no longer in use | Improving the store |
| Push notification tokens | Until you unsubscribe, disable notifications or close your account | Service you asked for |
| Data subject request records | Up to 3 years after the request is closed | Accountability and evidence of compliance |
9. How we protect your data
Section 25 of the Act requires appropriate technical and organisational measures. We use, as appropriate to the risk:
- Encryption of data in transit (HTTPS) across the whole site.
- Row-level security in our database, so each account sees only its own records, and admin endpoints protected by role checks and server-side keys.
- Strong authentication for our own administrative access, with least-privilege access.
- Payment details limited to a transaction code — we never hold M-PESA PINs or card data.
- Backups, monitoring and logging of administrative actions.
- Staff and contractors are bound to confidentiality, and we assess the privacy risk of new processing (such as analytics or advertising tools) before introducing it.
10. Your rights and how to use them
Section 26 of the Act gives you the right to be informed, to access your data, to object to processing, and to have false or misleading data corrected or deleted. Other sections add restriction, portability and protection from automated decisions. Contact privacy@sherrysmerchants.com or message 0740 209 121 with "Data protection request" in the subject or message.
| Your right | What it means | Our response time | Fee |
|---|---|---|---|
| Access (s.26(b), regulation 9) | A copy of the personal data we hold about you, and how we use it | Within 7 days | Free |
| Correction (s.26(d), s.40, regulation 10) | Fix data that is false or misleading | Within 14 days; we tell you in writing within 7 days if we must refuse, with reasons | Free |
| Deletion (s.40, regulation 12) | Erase data we no longer need or that was unlawfully processed | Within 14 days | Free |
| Objection (s.26(c), s.36, regulation 8) | Stop processing you object to — absolute for direct marketing and related profiling | Within 14 days | Free |
| Restriction (s.34, regulation 7) | Pause processing while accuracy or your objection is being resolved | Within 14 days | Free |
| Portability (s.38) | Receive your data in a structured, commonly used, machine-readable format | Within 30 days | Free |
| Withdraw consent (s.32) | Take back consent for marketing or analytics at any time | As soon as practicable | Free |
| Not be subject to automated decisions (s.35) | You are not subject to decisions made solely by automated means with legal or similarly significant effects — we do not make them | n/a | n/a |
We may ask for proof of identity before releasing data, to protect you from someone else impersonating you. If we cannot meet a request — for example because the law requires us to keep certain records — we tell you in writing with reasons and inform you of your right to complain to the Data Commissioner.
11. Children's data
A child is anyone under 18 in Kenya. Section 33 of the Act requires a parent or guardian's consent and age-verification mechanisms before a child's data is processed. Our store is intended for adults buying for themselves or their households; checkout and account creation are for people aged 18 and over.
- We do not knowingly create accounts for children.
- We do not profile children for direct marketing — that is prohibited by regulation 13(2)(b) of the General Regulations.
- If you believe a child has given us personal data, contact privacy@sherrysmerchants.com and we will delete it, unless the law requires us to keep it.
12. If something goes wrong
If a personal data breach creates a real risk of harm, section 43 of the Act requires us to notify the Office of the Data Protection Commissioner without delay and within 72 hours of becoming aware of it — and, if we are late, to explain why. We must also tell affected customers in writing within a reasonably practical period, unless we cannot identify them or encryption and other safeguards make the risk negligible.
Any notification we send will describe what happened, what data was involved, what we have done about it, what you can do to protect yourself, who is likely responsible, and how to reach our contact point. Our service providers must tell us about a breach without delay, and where reasonably practicable within 48 hours, so we can meet the 72-hour clock.
13. Complaints
Please contact us first at privacy@sherrysmerchants.com so we can try to put things right — we aim to acknowledge you within 7 days. You may also complain directly to the regulator at any time; you do not have to come to us first, and you may complain in writing, electronically or orally, and free of charge (regulation 4 of the Data Protection (Complaints Handling Procedure and Enforcement) Regulations, 2021).

14. Our registration status
Section 18 of the Data Protection Act requires data controllers and processors to register with the Data Commissioner, subject to the threshold in regulation 13 of the Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021 (an entity with annual turnover below KES 5,000,000 and fewer than 10 employees is exempt from registration, but must still comply with the Act).
You can ask us for our current registration status, or the number of our Certificate of Registration if we are registered, at privacy@sherrysmerchants.com. The register of registered controllers is a public document and can be checked with the ODPC.
15. Changes to this policy
We update this policy when our practices, our tools or the law change. The date at the top shows when it was last updated. If a change significantly affects how we use your data, we will draw your attention to it on the site or by email before it takes effect, so you can exercise your rights.
